Terms of Use

1. Introduction

This Terms of Use agreement ("Agreement") governs your use of the services provided by TFW Asset Recovery ("TFW," "we," "us," or "our"). By engaging our services, you ("Client," "you," or "your") acknowledge and agree to be bound by these terms.

2. Services

TFW Asset Recovery is a property asset management and recovery company. We assist Clients in recovering lost or unclaimed property and other assets.

3. No Upfront Fees

TFW does not charge any upfront fees for its services. Payment for our services is contingent upon successful recovery of the Client's assets.

4. Contingency Fee Structure

• General Assets: Upon successful recovery of assets (defined as "Financial Assets" below), TFW's fee will not exceed 10% of the recovered amount.
  • Financial Assets include:
    • Stocks, mutual funds, bonds, and dividends
    • Uncashed cashier's checks and money orders
    • Certificates of deposit
    • Matured or terminated insurance policies
    • Mineral interests and royalty payments
    • Trust funds and escrow accounts
    • Utility account deposits
    • Bank Accounts
    • Safe Deposit Box Content
• Estates: For estate-related recoveries, TFW's fee may not exceed 40% of the recovered assets.
• Real Estate: For real estate recoveries, TFW's fee may not exceed 40% of the recovered value.

5. Recovery Process

TFW will diligently work to locate and recover the Client's assets. This may involve:

• Conducting thorough research and investigation.
• Engaging with relevant legal and financial institutions.
• Representing the Client in legal proceedings, if necessary.

6. Risk Assumption

TFW assumes the risk associated with the recovery process. There is no guarantee of successful recovery, and TFW may incur costs without receiving payment.

7. Legal Compliance

TFW operates in full compliance with all applicable laws and regulations. Our in-house legal team ensures all recovery efforts are conducted ethically and responsibly.

8. Client Responsibilities

• The Client is responsible for providing TFW with accurate and complete information regarding the lost or unclaimed assets.
• The Client must cooperate fully with TFW throughout the recovery process.

9. Disclaimer of Warranties

TFW provides its services on an "as is" basis. We make no warranties, express or implied, regarding the success of the recovery efforts.

10. Limitation of Liability

TFW shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services.   

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of California.

12. Dispute Resolution

Any disputes arising from this Agreement shall be resolved through mediation, arbitration.

13. Modifications

TFW may modify these Terms of Use from time to time. Any changes will be effective upon posting on our website.

14. Severability

If any provision of this Agreement is found to be invalid or unenforceable, such provision shall be severed from this Agreement, and the remaining provisions shall remain in full force and effect.   

15. Entire Agreement   

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
